1. Acceptance of Terms
By accessing and using Pacific Jewel ("Site"), you accept and agree to be bound by and comply with these Terms of Service and our Privacy Policy. If you do not agree to abide by the above, please do not use this service. Pacific Jewel reserves the right to update these Terms of Service at any time without notice. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
2. Products and Orders
Product Descriptions
We strive to provide accurate descriptions and images of all products. However, we do not warrant that product descriptions, pricing, or images are accurate, complete, reliable, current, or error-free. If a product offered by Pacific Jewel is not as described, your sole remedy is to return the item in unused, original condition for a full refund (see Returns and Exchanges).
Order Acceptance
All orders are subject to acceptance and confirmation by Pacific Jewel. We reserve the right to refuse, cancel, or place limits on any order. We reserve the right to discontinue any product at any time.
Availability
Products are offered on a limited-availability basis. Once sold out, items may not be restocked. Made-to-order items have specific production timelines and cannot be expedited.
3. Pricing and Payment
Pricing
All prices are in USD and subject to change without notice. Prices displayed on the Site are valid only at the time of viewing. We reserve the right to correct any errors in pricing that appear on the Site, including after an order has been placed.
Taxes and Shipping
Applicable sales tax and shipping costs will be added to your order at checkout. You are responsible for paying all applicable taxes based on your location.
Payment Method
Payment must be received in full before orders are processed and shipped. We accept payment via Stripe, which processes credit cards, debit cards, and other payment methods securely. By providing payment information, you warrant that you are authorized to use the payment method and that the information is accurate.
Billing Information
You agree to provide current, complete, and accurate billing and shipping information. You are responsible for notifying us of any changes to this information.
4. Shipping
Shipping costs and estimated delivery times are provided at checkout. Estimates are based on standard processing and delivery times and are not guaranteed. Transit times may vary due to carrier delays, weather, or other factors beyond our control. International orders may be subject to customs delays and duties.
Once an order ships, we will provide a tracking number via email. Pacific Jewel is not responsible for lost, stolen, or damaged packages once they have been shipped. We recommend purchasing shipping insurance for high-value orders.
For made-to-order items, production timelines are provided at order placement. Production times do not include shipping time.
5. Returns and Exchanges
For complete details on our return and exchange policy, please visit our Policies page. Key points include:
- Items must be returned within 30 days of receipt
- Items must be in unused, unworn condition with original packaging
- Made-to-order and custom items are non-returnable and non-exchangeable
- Refunds are issued to the original payment method after inspection
- Return shipping is the customer's responsibility unless the item was defective
6. Custom and Fine Jewelry Orders
Custom and fine jewelry orders (engagement rings, wedding bands, heirloom redesigns, etc.) are non-refundable once production begins. A 50% non-refundable deposit is required to start production, with the balance due before shipment.
Custom items are created to your specifications and may require multiple consultations and design revisions. Production timelines are provided at order placement and depend on the complexity of the design and current workload.
All custom orders are final sales. Modifications or cancellations after production has begun may result in partial or complete loss of deposit. For details, contact sara@pacificjewel.com.
7. Intellectual Property
All content on the Site, including text, images, jewelry designs, photographs, graphics, and software, is the exclusive property of Pacific Jewel or its content suppliers and is protected by international copyright laws. You may not copy, reproduce, modify, distribute, or transmit any content without written permission from Pacific Jewel.
8. Limitation of Liability
To the fullest extent permitted by law, Pacific Jewel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or business interruption, arising from or in connection with your use of the Site or products, even if advised of the possibility of such damages.
In no event shall Pacific Jewel's total liability exceed the amount paid by you for the product or service that gave rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Pacific Jewel, its officers, employees, and agents from any and all claims, damages, losses, costs, and expenses (including attorneys' fees) arising from your use of the Site, your products, or your violation of these Terms of Service.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California.
11. Dispute Resolution
Any dispute arising from these Terms of Service or your use of the Site shall first be addressed through informal resolution. You agree to contact Pacific Jewel at sara@pacificjewel.com to attempt to resolve the dispute informally.
If informal resolution fails, any legal proceeding shall be conducted on an individual basis and not as a class action or representative action.
12. Modifications to Terms
Pacific Jewel reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any modifications constitutes your acceptance of the revised Terms.
